Membership terms

Draft for legal reviewThese terms are published in draft so that applicants can see what they will be asked to agree to. They are not yet in force. A lawyer-reviewed version replaces this page before the first application outside the founding group is accepted, and every member is notified of the change.

1. Who these terms are between

CPD Council (legal entity, ABN, on registration) and the organisation named on the application ("the member").

2. What membership is

Membership means the member has been verified against the CPD Council Standard, is listed on the public register, and is licensed to use the CPD Council mark in line with the Mark rules. Membership is not accreditation, endorsement or approval by any regulator, and the member must not describe it as such.

3. Verification and re-verification

  • Verification lasts 24 months from the date on the record.
  • Re-verification is by a fresh sample. The member supplies updated documents on request.
  • CPD Council may carry out a sample check at any time with 10 business days' notice.
  • Each standard is recorded as Met or Not met with the evidence examined. All eight must be met for the member to be listed as Verified.

4. The member's obligations

  • Keep the procedures that were verified in operation.
  • Keep the activity list on the register current. Expired activities are withdrawn from sale or re-reviewed.
  • Use the mark only as the Mark rules allow, and remove it within 14 days of an activity or the membership ceasing to be verified.
  • Tell CPD Council within 10 business days of any change that affects verification: a change of reviewer, a regulator's finding, a substantiated complaint.
  • Not claim, in any medium, that CPD Council is a regulator or that verification is regulator approval.

5. Fees

  • Founding period. No application fee and no listing fee until the register reaches 100 verified providers (related parties not counted).
  • After 100. A membership fee of $1,000 + GST a year (or the published New Zealand equivalent) applies to new members from the date the register reaches 100. Founding members move to the fee on the first anniversary of their membership after that date.
  • Notice. Every member is told in writing when the register reaches 75, with the expected date the fee begins. The fee is also stated on this page and on the application page.
  • Founding rate. A reduced first paid year for founding members is being decided and will be published before the fee begins.
  • Non-payment. If a fee is unpaid 30 days after the anniversary, the status changes to Not current, the live badge changes, and the record is marked accordingly. The record is withdrawn after a further 30 days.

6. Suspension and removal

CPD Council may suspend a membership while a complaint or re-review is under way, and may withdraw it where a standard is not met and not fixed within 30 days, where the mark is misused after a written warning, or where verification expires. Suspensions and withdrawals are published on the register with the date and reason. A withdrawn member may reapply after six months. The member may respond to any complaint before a decision and may ask the advisory group to review a decision.

7. The register and publicity

The member agrees that its record, including status, dates, reviewer, results per standard, brands and activity list, is public, and remains on the register with its history after membership ends.

8. Liability

CPD Council verifies process and a sample. It does not review every activity and does not guarantee the content of any activity. To the extent the law allows, CPD Council is not liable for loss arising from reliance on a verification. Nothing here limits rights under the Australian Consumer Law or the New Zealand Consumer Guarantees Act.

9. Changes

Changes to these terms or to the Standard are published with at least 90 days' notice to members, except changes required by law.

10. Law

These terms are governed by the law of state, on legal advice, Australia. New Zealand members may bring proceedings in New Zealand.
